Oregon DUII Typical Penalties
First DUII Conviction
(Applicable if ineligible for diversion, CDL, or any injury to another)
- Probation: 18-36 months.
- Jail: 2-10 days (can be more if additional crimes charged. In some courts community service may be available instead of jail).
- Fine: $1,000-$3,000 + court fees (fines are generally dictated by the BAC involved).
- License: 1-year suspension.
- Mandatory: substance abuse classes, victims impact class, no alcohol, no bar entry, valid license and SR-22 insurance to drive.
- Class A misdemeanor.
First DUII Citation
Applicable when no injuries to others and no Commercial Driver License or Permit
- Likely to enter DUII diversion if eligible (See Diversion Eligibility Quick Guide).
- If ineligible for diversion, see First DUII Conviction.
- Class A misdemeanor.
Second DUII Conviction
- Probation: 24-60 months.
- Jail: 10-60 days (more if additional crimes charged or DUII probation revoked for non-compliance).
- Fine: $1,500-$3,500 + court fees.
- License: 1-3 years suspension (3 years if prior DUII arrest within 5 years).
- Mandatory: substance abuse classes, victims impact class, no alcohol, no bar entry, valid license and SR-22 insurance to drive.
- Class A misdemeanor.
Third or More DUII Convictions
(3 DUII convictions w/n 10 years become a felony see below)
- Probation: 36-60 months.
- Jail: 30-180 days (more if additional crimes charged or DUII probation revoked for non-compliance).
- Fine: $2,000-$4,000 + court fees.
- License: Lifetime revocation w/ no hardship permit (can petition for reinstatement after 10 years).
- Mandatory: substance abuse classes, victims impact class, no alcohol, no bar entry, valid license and insurance.
- Class A misdemeanor
Third or More DUII Convictions
(Felony as per ORS 813.011, 3 convictions in 10 years, or prior felony DUII)
- Probation: 36-60 months.
- Jail: Minimum 90 days up to 5 years prison.
- Fine: $2,000-$4,000 + court fees.
- License: Lifetime revocation w/ no hardship permit (can petition for reinstatement after 10 years).
- Mandatory: substance abuse classes, victims impact class, no alcohol, no bar entry, valid license and insurance.
